Please read these Terms and Conditions carefully before using SiloVista. By creating an account or using this service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using SiloVista ("the Service"), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Service.
2. Description of Service
SiloVista provides a platform that allows event organisers ("Admins") to create photo-sharing events and invite guests to upload and view photos in real time via a live slideshow. The Service is provided on a subscription basis with tiered plans.
3. Account Registration
Admin accounts are created using a passwordless magic-link system tied to your email address. You are responsible for maintaining the security of your email account. You must provide accurate information and must not share your account access with others.
You must be at least 18 years old to create an Admin account.
4. Photo Content and Ownership
All photos uploaded to the Service remain the intellectual property of the original photographer or the event organiser as applicable. By uploading photos you grant SiloVista a limited, non-exclusive licence to store and display those photos solely for the purpose of operating the Service for your event.
You must not upload photos that:
- Depict nudity, violence, or illegal activity
- Infringe the copyright or privacy rights of any person
- Are defamatory, harassing, or otherwise unlawful
We reserve the right to remove any content that violates these terms without notice.
5. Acceptable Use
You agree not to use the Service to:
- Attempt to gain unauthorised access to any part of the platform
- Upload malware, viruses, or any malicious code
- Use automated scripts to upload content in bulk without authorisation
- Resell or sublicense access to the Service to third parties
- Use the Service for any purpose that is unlawful or prohibited by these Terms
6. Subscription and Billing
Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.
Free tier accounts are subject to the limits described in your account dashboard. Exceeding those limits may result in uploads being declined until the account is upgraded.
7. Data Storage and Retention
Photos and event data are stored on secure servers. We retain your data for as long as your account is active. If you delete an event or close your account, associated photos and data will be permanently deleted within 30 days.
We do not sell your data or your guests' data to third parties. Guest names and upload activity are used solely to operate the Service for your event.
8. Service Availability
We aim to keep SiloVista available at all times but do not guarantee uninterrupted access. Scheduled maintenance, technical failures, or circumstances beyond our control may result in temporary unavailability. We are not liable for any loss resulting from downtime.
9. Limitation of Liability
To the fullest extent permitted by law, SiloVista shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of photos, data, or revenue.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the United States and the state in which Silo Vista Media LLC is registered. Any disputes shall be subject to the exclusive jurisdiction of the courts of that state.
